Sean Russell

As a San Diego antitrust attorney, Mr. Russell represented class plaintiffs in In re Foreign Exchange Benchmark Rates Antitrust Litigation, No. 1:13-cv-07789 (S.D.N.Y.), an action challenging collusion in the foreign exchange market that resulted in over $2.3 billion in settlements. He also represented class plaintiffs in Alaska Electrical Pension Fund v. Bank of America Corp., No. 1:14-cv-07126 (S.D.N.Y.), an action regarding the setting of the ISDAfix benchmark interest rate, which settled for $504.5 million. Mr. Russell's antitrust work also included representing cattle ranchers and futures traders in In re Cattle Antitrust Litigation, No. 22-md-03031 (D. Minn.), alleging a conspiracy among the nation's largest meatpackers to suppress cattle prices, and representing plaintiffs in Deslandes v. McDonald's USA, LLC, No. 1:17-cv-04857 (N.D. Ill.), a labor antitrust action challenging no-poach agreements among McDonald's franchisees.

In data privacy and consumer protection class actions, Mr. Russell represented the class in Veridian Credit Union v. Eddie Bauer LLC, No. 2:17-cv-00356 (W.D. Wash.), a data breach action that settled for $9.8 million. He represented consumers in Lopez v. Apple, Inc., No. 4:19-cv-04577 (N.D. Cal.), alleging that Apple's Siri voice-activation devices improperly recorded, stored, and shared private conversations resulting in a $95 million dollar settlement, and in In re: Google Assistant Privacy Litigation, No. 5:19-cv-04286 (N.D. Cal.), a class action alleging that Google Assistant records and discloses users' private communications without consent.

Mr. Russell's commitment to his clients is grounded in the belief that every client — whether an individual consumer, a family-owned business, or a multinational corporation — deserves direct access to the lawyer they retained and the full weight of that lawyer's attention. It is a standard he has carried throughout his career and the foundation on which Noss & Russell was built.

Prior to founding Noss & Russell, Mr. Russell practiced at Scott+Scott Attorneys at Law in the firm's San Diego office. Before re-joining Scott+Scott, he was a member of Wilson Elser's data breach class action litigation defense team and assisted with other class action defense matters as needed — experience defending companies that now informs how he prosecutes class actions against them. Outside the office, Mr. Russell is a tech enthusiast and longtime video game aficionado whose interests range from retro consoles to the latest releases. He is also an avid sailor, fisherman, and outdoorsman, and has competed in numerous sailing races aboard boats ranging from 22 to over 50 feet. Above all, he treasures time spent with his wife, kids, animals, extended family, and friends.
